Property Transfers - 56ZQ Land Certificates
Southern Water can provide a Land Information Certificate (56ZQ), formally included as part of the Council 337 application, to customers or their solicitor. These certificates are primarily used when purchasing or selling property and provide a report of the water and sewer infrastructure for that property that are maintained by Southern Water.
Under Sect 56ZQ of the Water and Sewer Industry Act:
A person may apply in writing to Southern Water for a certificate in respect of information concerning water and sewerage relating to land specified and clearly identified in the application.
Southern Water, on receipt of an application, will issue a certificate in the prescribed form with answers to prescribed questions that are attached to the certificate.
This certificate relates only to information that the Southern Water has on record as at the date of issue of the certificate.
The applicant is to pay to the Southern Water the prescribed fee on or before the issue of the certificate.
Southern Water, on request, may provide in, or with, the certificate any other information or document relating to the land that the Southern Water considers relevant.
A person, with the consent of the occupier or owner of specified land, may request in writing to Southern Water that an inspection be carried out of that land to obtain supplementary water infrastructure or sewerage infrastructure information relevant to that land.
If Southern Water agrees to a request to supply further information or inspect the site as above, Southern Water may impose any reasonable charges for costs incurred.
Southern Water does not incur any liability in respect of any information provided in good faith from sources external to the Southern Water.
Southern Water will endeavour to complete a 56ZQ request within 14 calendar days.
Clause 14 of the Water and Sewerage Industry (General) Regulations contains the fee for a 56ZQ certificate, the fee is governed by the value of 25 fee units for each financial year. The fee for 2012/2013 is $36.00.

Alternatively, please email the completed form to Southern Water (56zq@southernwatertas.com.au) and follow with a cheque in the mail.
Once payment is received Southern Water will complete the certificate and return it to the applicant by email within 14 days.
